Patricia Vázquez López hereinafter the RESPONSIBLE party, is responsible for the processing of the USER’S personal data and informs you that this data will be processed in accordance with the provisions of the current regulations on personal data protection, Regulation (EU) 2016/679 of April 27, 2016 (General Data Protection Regulation, GDPR hereafter) on the protection of private individuals with regard to the processing of personal data and on the free movement of such data, and the Spanish Organic Law 3/2018 of December 5, on the Protection of Personal Data and guarantee of digital rights, so the following information about the processing is provided.

Purpose of Data Processing

We collect information from you to maintain a commercial relationship with the USER. The planned operations for processing include:

Sending advertising commercial communications via email, SMS, MMS, social communities, or any other electronic or physical means, present or future, which enables commercial communications. These communications will be carried out by the RESPONSIBLE party and will be related to their products and services, or those of their collaborators or providers with whom they have reached a promotion agreement. In this case, third parties will never have access to personal data.

Processing orders, requests, or any type of inquiries made by the USER through any of the contact forms provided.

Data Retention Criteria

Data will be retained for as long as there is a mutual interest in maintaining the purpose of processing, and when it is no longer necessary for that purpose, it will be deleted with appropriate security measures to ensure data pseudonymization or complete destruction.

Data Disclosure

Data will not be disclosed to third parties except as required by law.

Right to withdraw consent at any time.
Right to access, rectify, transfer, and delete their data, as well as to limit or oppose its processing.

2. MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER

This website collects personal data in the following instances:

When you sign up to reserve a Spanish class.
During the purchase process of any of our products.
When the USER requests information using our contact form.
When making a reservation for a class on our calendar.
When leaving comments on pages that allow this option.

In any of these circumstances, by checking the corresponding boxes and entering data in fields marked with an asterisk (*), USERS are expressly and freely and unequivocally agree that their data is necessary to fulfill their request by the provider, with the inclusion of data in the remaining fields being voluntary. The USER guarantees that the personal data provided to the RESPONSIBLE party is accurate and is responsible for communicating any changes to it.

We do not collect information about the USERS’ bank details and/or debit or credit cards since financial transactions are carried out through the PAYPAL platform. Additionally, all communications between the website and the USER are secured by an SSL security certificate, allowing the USER to verify at any time that the visited page belongs to the SITE by checking the URL and the “secure site” symbol displayed in front of this URL, which will be of the https type.

The RESPONSIBLE party expressly informs and guarantees to USERS that their personal data will not be transferred to third parties under any circumstances, and that whenever any type of personal data transfer is made, the express, informed, and unequivocal consent of the USERS will be requested beforehand. All data requested through the website is mandatory since it is necessary for the provision of an optimal service to the USER. If all of the data is not given, the information and services provided cannot be guaranteed to be fully tailored to their needs.

3. SECURITY MEASURES

In accordance with the provisions of the current regulations on personal data protection, the RESPONSIBLE party is complying with all the provisions of the GDPR and the Spanish Organic Law on Data Protection (Ley Orgánica de Protección de Datos, LOPD) for the processing of personal data under its responsibility, and manifestly with the principles described in Article 5 of the GDPR and Article 4 of the LOPD, by which they are processed lawfully, fairly, and transparently in relation to the data subject and are adequate, relevant, and limited to what is necessary in relation to the purposes for which they are processed.

The RESPONSIBLE party guarantees that appropriate technical and organizational policies have been implemented to apply the security measures established by the GDPR and LOPD in order to protect the rights and freedoms of the USERS and has provided them with the appropriate information to enable them to exercise those rights.

The SITE cannot assume any responsibility in the event that the page or its data storage system is attacked by hackers, which may result in the misuse of your information. However, we guarantee that we will always do our best to protect our system with the technology at our disposal to prevent such breaches.

Valoramos su privacidad y estamos comprometidos en proteger su información personal. Esta Política de Privacidad explica cómo recopilamos, usamos, revelamos y protegemos su información cuando utiliza nuestro sitio web o servicios.

Patricia Vázquez López en adelante RESPONSABLE, es la Responsable del tratamiento de los datos personales del Usuario y le informa de que estos datos serán tratados de conformidad con lo dispuesto en las normativas vigentes en protección de datos personales, el Reglamento (UE) 2016/679 de 27 de abril de 2016 (GDPR) relativo a la protección de las personas físicas en lo que respecta al tratamiento de datos personales y a la libre circulación de estos datos, y la Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y garantía de los derechos digitales, por lo que se le facilita la siguiente información del tratamiento:

Finalidad del tratamiento

Recopilamos información suya para mantener una relación comercial con el Usuario. Las operaciones previstas para realizar el tratamiento son:

Remisión de comunicaciones comerciales publicitarias por email, SMS, MMS, comunidades sociales o cualquier otro medio electrónico o físico, presente o futuro, que posibilite realizar comunicaciones comerciales. Estas comunicaciones serán realizadas por la RESPONSABLE y relacionadas sobre sus productos y servicios, o de sus colaboradores o proveedores con los que este haya alcanzado algún acuerdo de promoción. En este caso, los terceros nunca tendrán acceso a los datos personales.
Tramitar encargos, solicitudes o cualquier tipo de petición que sea realizada por el Usuario a través de cualquiera de las formas de contacto que se ponen a su disposición.

Criterios de conservación de los datos

Se conservarán mientras exista un interés mutuo para mantener el fin del tratamiento y cuando ya no sea necesario para tal fin se suprimirán con medidas de seguridad adecuadas para garantizar la seudonimización de los datos o la destrucción total de los mismos.

Comunicación de los datos

No se comunicarán los datos a terceros, salvo obligación legal.

Derechos que asisten al Usuario:

Derecho a retirar el consentimiento en cualquier momento.
Derecho de acceso, rectificación, portabilidad y supresión de sus datos y a la limitación u oposición a su tratamiento.

2. CARÁCTER OBLIGATORIO O FACULTATIVO DE LA INFORMACIÓN FACILITADA POR EL USUARIO

Esta página recopila datos personales:

Al inscribirse para reservar una clase de español para que los USUARIOS comprueben cómo funciona el sistema de enseñanza de la página.
Durante el proceso de compra de cualquiera de nuestros productos.
Cuando el USUARIO pide información utilizando nuestro formulario de contacto.
Al realizar una reserva para una clase en nuestro calendario.
Al realizar comentarios en las páginas que permiten esta opción.

En cualquiera de estos puntos, los Usuarios, mediante la marcación de las casillas correspondientes y entrada de datos en los campos marcados con un asterisco (*), aceptan expresamente y de forma libre e inequívoca que sus datos son necesarios para atender su petición por parte del prestador, siendo voluntaria la inclusión de datos en los campos restantes. El Usuario garantiza que los datos personales facilitados a la RESPONSABLE son veraces y se hace responsable de comunicar cualquier modificación de los mismos.

No recopilamos información sobre los datos bancarios y/o las tarjetas de débito o de crédito de los USUARIOS ya que las transacciones económicas se realizan a través de la plataforma PAYPAL. En cualquier caso, todas las comunicaciones entre la página y el USUARIO están aseguradas mediante un certificado de seguridad SSL, de tal forma que el USUARIO puede comprobar en cualquier momento que la página visitada pertenece al SITIO verificando la URL y el símbolo de “sitio seguro” colocado delante de esta URL, que será del tipo https.

La RESPONSABLE informa y garantiza expresamente a los usuarios que sus datos personales no serán cedidos en ningún caso a terceros, y que siempre que realice algún tipo de cesión de datos personales, se pedirá previamente el consentimiento expreso, informado e inequívoco por parte los Usuarios. Todos los datos solicitados a través del sitio web son obligatorios, ya que son necesarios para la prestación de un servicio óptimo al Usuario. La RESPONSABLE garantiza que ha implementado políticas técnicas y organizativas apropiadas para aplicar las medidas de seguridad que establecen el GDPR y la LOPD con el fin de proteger los derechos y libertades de los Usuarios, y les ha comunicado la información adecuada para que puedan ejercerlos.

El SITIO no puede asumir ninguna responsabilidad en el caso de que la página o su sistema de almacenamiento de datos sea atacado por ‘hackers’, lo que puede causar un uso indebido de su información. Sin embargo, garantizamos que siempre haremos lo posible para proteger nuestro sistema con la tecnología que se encuentra a nuestro alcance para impedir este tipo de violaciones.
